'A' joins service by 10(1) in 1990 regularised on 1993 and got CML No. 7500 'B' joins service by TNPSC in 1991 and regularised on 1991 and got CML No.6000.
Let us assume both are on same specialty.
'B' get POP as CCS as per GO Sec.III in 2010. If CSS of his specialty is vacant, then he ought to move too that post inspite of his lesser CML No.than 'A'. (As per GO, if no vacancy or no DP pending, then only after 20 years one is elevated from present post to CCS. But, if vacancy persist, he should accept that otherwise he will loose CCS time bound promotion).
Due to earlier reach of B to 20 years, he close a vacancy in his CSS specialty post. So, when A reaches 20 years, there won't be any vacancy for him since B already closed the CCS specialty vacancy.
Here 'A" cannot claim his earlier promotion as per Sec.III (vii) of G.O. So, CML No. seniority become invalid and Temporary appointment doctors moves to promotion on their specialty faster than TNPSC selected one inspite of having TNPSC selected doctors' advanced seniority. This is violative of Supreme court judgment wherein it is stated adhoc (10(1) appointment period (till selected by TNPSC) is not to be counted for seniority.
My suggestion is that after 20 years, B should be given a time bound promotion i.e. hike to CCS salary but his promotion to CCS specialty to be as per Specialty Seniority only. This way, there won't be any jumping of 10(1) doctors over TNPSC selected doctors. i.e. mere reaching 20 years of service not to be a criteria for CSS specialty promotion but only CML Specialty is main criteria for become CCS specialty. In nutshell, CML Specialty should determine the promotion and not reaching 20 years of service.
